END USER LICENSE AGREEMENT (EULA)
This license agreement governs Photo FX Plus Screensavers, Active Desktops, and Free Printable Greeting Cards (tm) ("Software"). By installing this software you enter into the terms of this binding contract between you ("you" or "User") and Photo FX Plus. Installation of the Software constitutes acceptance of the terms of this License Agreement.
Limitations: The Software is licensed, not sold, to you. You must retain all copyright and related notices of Photo FX Plus ownership and other rights in the Software in the product, labeling and documentation provided.
Limitation of Liability: IN NO EVENT WILL PHOTO FX PLUS BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, DIRECT OR INDIRECT DAMAGES ARISING FROM OR RELATING TO THE USE OF THE SOFTWARE, HOWEVER CAUSED ON ANY THEORY OF LIABILITY. THIS LIMITATION WILL APPLY EVEN IF PHOTO FX PLUS HAS BEEN ADVISED OR GIVEN NOTICE OF THE POSSIBILITY OF SUCH DAMAGE. THE ENTIRE RISK AS TO THE USE OF THE SOFTWARE IS ASSUMED BY THE USER.
Disclaimer of Warranty: TO THE EXTENT PERMITTED BY APPLICABLE LAW ALL PHOTO FX PLUS SOFTWARE, INCLUDING THE IMAGES AND/OR COMPONENTS, IS PROVIDED "AS IS" AND WITHOUT EXPRESS OR IMPLIED WARRANTY OF ANY KIND BY EITHER PHOTO FX PLUS OR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF SUCH SOFTWARE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY, NO INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. NO COVENANTS, WARRANTIES OR INDEMNITIES OF ANY KIND ARE GRANTED BY PHOTO FX PLUS TO THE USER.
Photo FX Plus Screensavers and Active Desktops
Grant of License: Subject to the terms and conditions of this Agreement, Photo FX Plus hereby grants you a limited, nonexclusive license to install and use the Software on a single personal computer.
Furthermore, you may not:
- Modify, translate, de-compile, reverse engineer, disassemble or otherwise decode the Software.
- Copy any of the Software other than as reasonably required for your own personal use of the Software in accordance with this Agreement.
- Sublicense, sell, rent, lend, transfer, post, transmit, distribute or otherwise make the Software available to anyone else.
Photo FX Plus Free Printable Greeting Cards
Free Printable Greeting Cards are formatted as jpeg images and should not present any problems to your computer. However by downloading and/or printing these images you agree to do so at your own risk. If any problems should occur, Photo FX Plus and/or affiliates will not be responsible in any manner.
Please be advised that all of the clip-art used in these cards are copyrighted images to which Photo FX Plus has either been granted or purchased a commercial license. They may not be copied or distributed in any manner as stand-alone images.
Furthermore, you may not:
- Sell the Software.
- Use the Software in any advertisements.
- Remove any of the credits and or copyright information on the Software.
- Use the Software in any manner which may promote a profit to yourself or others without the express written permission of Photo FX Plus.
Subscriptions: The subscription product was implemented on December 03, 2007. As of this date Photo FX Plus will be limiting Free Printable Downloads to a maximum of 1. When this maximum amount has been reached the account holder will be required to pay a subscription price prior to any future downloads. All account holders whom have created their account prior to this date will not be affected and will be allowed continued total access to unlimited downloads for a period of 30 days after the subscription program has been implemented. Upon the implementation of the subscription program all account holders should have received an email notification to the email address specified in the account.
eBay Auction Items: All items advertised at the Photo FX Plus eBay Online Store are the sole property of the seller. Photo FX Plus does not assume, nor guarantee and will not be responsible in any manner for the validity of the advertisement and or the product advertised. You as the buyer assume complete and total responsibility for all transactions, product research, and any product guarantees between you and the seller towards these products. You may contact Photo FX Plus concerning any complaint of a product advertised at the Photo FX Plus eBay Online Store. After investigating the complaint, Photo FX Plus will at its option and depending upon the outcome of the investigation remove the item from the Photo FX Plus eBay Online Store and forward the complaint to eBay.

Refunds: The trial version Screen saver and Active Desktop software has a 72 hour grace period, when this time has expired you will need to register the Software prior to use. After the registration number for the Software has been emailed, there will be no refunds granted. With regard to subscriptions to Free Printable Downloads, after the subscription price has been paid there will be no refunds granted.
Termination: If you do not accept the terms of this license, you agree to destroy all copies of the Software in your possession and control.
